Supervision of institutions with a FinTech licence

Institutions with a FinTech licence (persons under Article 1b BA) are subject to supervision by FINMA. Supervision is carried out based on the respective principles and risks.

When supervising institutions with a FinTech licence, FINMA takes account of the fact that the deposits are not covered by deposit protection pursuant to the Banking Act. The legal basis for the supervision of institutions with a FinTech licence can be found in the Banking Act (BA), the Banking Ordinance (BO) as well as further details in the corresponding FINMA circulars.

Disclosure requirements

Any change to the basis on which the licence was granted must be reported to FINMA. If the changes are of material significance, prior authorisation must be obtained from FINMA in order to continue the activity.
