FINMA may appoint investigating one or several agents to investigate circumstances relevant for supervisory purposes or implement regulatory measures that it has ordered. FINMA defines the duties of these investigating agent(s) in the appointment order and determines the extent to which the investigating agent(s) may act in the place of the management bodies of the supervised entity (cf. Art. 36 FINMASA). Investigating agent(s) are normally appointed by way of an interlocutory order.
