Appointing investigating agents

FINMA may appoint an investigating agent to investigate circumstances relevant under supervisory law or to implement regulatory measures it has ordered. FINMA defines the duties of the investigating agent(s) in the appointment order and determines the extent to which the investigating agent(s) may act in the place of the supervised entity's governing bodies (cf. Art. 36 FINMASA). Investigating agent(s) are normally appointed by way of an interlocutory order.
